ALE, POSSESSION, AND TRANSPORTATION OF DRUGS

At the Law Offices of John D. Kirby, A.P.C., our drug crime practice covers a significant amount of ground. We defend anyone facing a state or federal drug charge, for minors and young adults facing a first-time drug possession charge to professionals whose careers are jeopardized by allegations of prescription drug crimes. There is no such thing as a minor drug charge. While some cases may be more straightforward others, and not all convictions result in incarceration, all cases come with the potential of a criminal record that can end promising careers before they even begin. In the most serious federal and state drug crime cases, the penalties that come with a conviction can be devastating. It is critical that, if you have been charged or if you are under investigation, you retain an experienced criminal defense lawyer as soon as possible to protect your rights.

DRUG OFFENSES

The drug law climate in California is rapidly changing, especially with respect to marijuana.  Despite strides to protect individual and business rights, San Diego’s marijuana laws are among the least lenient in the state.  Violators can face heavy fines, confiscation of property, and even lengthy prison sentences.  We can help you defend against a variety of charges, including:

  • Trafficking
  • Manufacturing
  • Possession
  • Grow Houses & Meth Labs
  • Drug Trafficking
  • Importation & Transportation
  • Prescription Drugs
  • Oxycontin Charges

We also handle cases in which FDA defense is required for supplement manufacturers accused of illegally making and distributing prescription drugs.

San Diego Drug Trafficking Lawyer

Drug trafficking involves the cultivation or manufacture, importation and transportation, and distribution and sale of a controlled substance such as marijuana, methamphetamines or even prescription drugs. People can also be charged with drug trafficking if they are accused of being in possession of a controlled substance with the intent to do any of the above. These charges are typically based on the amount of the controlled substance a person is accused of possessing. In California, the penalties associated with drug trafficking charges are among the most serious in the entire country, because it is a border state.

Early intervention in drug distribution and trafficking cases can be critical. Even if you are under investigation and have not yet been charged, retaining our services early in the process can help set the stage for a positive outcome.

At the Law Offices of John D. Kirby, A.P.C., we defend people accused of importing controlled substances into California from Mexico or other countries, as well as people accused of transporting illegal substances through the state or across state lines. Cases we handle may involve importation and transportation of marijuana, methamphetamines or any other controlled substance, including prescription drugs.

Being a border state, California takes great care to guard against importation and transportation, as well as all other aspects of drug trafficking. The state and federal governments actively fight trafficking operations, inflicting severe penalties on those convicted. Whether you have been charged or you are under investigation, it is important that you retain an experienced criminal defense attorney as soon as possible.

Importation and Transportation by Vehicle

Many drug trafficking cases begin with a simple traffic stop. Perhaps the stop was preceded by an investigation of some sort. Perhaps the stop was for speeding or some other traffic violation. In either case, we understand the importance of reviewing exactly how the investigation and the traffic stop were conducted. Any missteps on the part of law enforcement, or any oversights of your constitutional rights, can yield positive results.

Importation and Transportation by Mail

We are available to represent people accused of sending or receiving marijuana, methamphetamine, prescription drugs or other controlled substances through the United States Postal Service (USPS), United Parcel Service (UPS) or any other delivery service.

What Have You Been Charged With?

Prescription drug cases rarely involve charges of possession alone. This charge is typically just the starting point. The accused will be charged with possessing a prescription drug without a prescription. These cases also typically involve allegations of stealing prescription pads and forging doctors’ signatures, or going from doctor to doctor and falsely obtaining multiple prescriptions, which can lead to the additional charge of prescription fraud. If the case involves allegations of stealing prescription medication, prescription theft may also be charged.

To add to the seriousness of these cases, burglary charges are often added on. Burglary is defined as entering a premises with the intent to commit a crime. Since people accused of these crimes often allegedly entered a pharmacy to commit a crime, the burglary charge is supposedly justified. We can defend against every one of the charges you face.
